You have to use the 1040 when you claim the credit on the 5405. But if you already filed your 2008 return and you want to claim the credit on your '08 return, then you will need to file Form 1040X to claim the credit. You will have to mail in with the 1040X the 5405, a copy of the HUD-1 statement and the seals. This will take 16 to 20 weeks to process.

If you haven't filed at all, use form 1040. This is the only form with a line for it.
If you have already filed, use form 1040x, starting at line 10. The credit goes on line 15.

Depending on where you live/want to buy you may be eligible for the no money down USDA mortgage.

The program does have household income limits and the home has to be located in a rural area or a USDA designated area. In addition to 100% financing, the USDA mortgage does not require monthly mortgage insurance.

If this not an option for you, your next best bet is an FHA loan with just 3.5% down required. The down payment can also be gifted to you by a family member.

Now a days all loan programs require money to be used for a down payment and/or closing costs. The two lowest options are a VA loan (0 down payment if you are a veteran) and an FHA loan (3.5% down payment). In many states there are programs aimed to help lower income buyers with either forgivable small second mortgages to cover down payment/closing costs or special rates for small second mortgages which will cover these costs. The place to find them is through your state's housing department, and it takes some searching to find them. Often it is called the "Home" program and to qualify for it you have to make at or below the state's median income. Good Luck!

Sorry, but you won't qualify for it. But in actuality, it's not a very good deal, as it has to be repaid over a 15 year window. So don't lose any sleep over it.

Yep, you are excluded from the credit without a doubt. You already bought your first home and it makes no difference if you were the only owner or if 12 other people owned it with you.

The credit is refundable. That means you get the amount you're entitled to even if reduces your tax below zero.

See details at http://www.irs.gov/newsroom/article/0,,id=186831,00.html

Not sure what you mean by "if you don't use all of it". It's a refundable credit, so if for example your tax liability was $ 3000 and your credit was $ 7500, you'd get a check for the other $ 4500. If you don't use all of it because the house you buy doesn't qualify for the full $ 7500 credit, then no it doesn't carry over, since a house you'd buy the next year wouldn't be a first time home buy.

Check out first time homebuyer programs in you state.

Arizona just got 400 million dollars to offer first time homebuyer's in this state.

5% GRANT never has to be paid back.

Can be used for down payment, pre-paids, closing costs.

Here is the info for Arizona.

fha requires 2.25% down payment.
most 1st time home owners use this program....rates are pretty good for hardly putting any money down.

mycommunity /homepossible is zero down with a slightly higher rate of around 7% for 30yr fixed

these 3 are all first time home buyer programs

A great place to start is www.hud.gov. This is the official website for the US Department of Housing and Urban Development. They offer a good walk-through of how to go about buying a home. There are also links available to programs for first-time homebuyers, which may offer assistance in lower rates, down payment assistance, or even both.

You also mentioned some worries about being taken by a real estate agent. What you might want to consider is using what is called a buyer's agent. Basically, it puts a real estate agent in your corner too. They will end up splitting the commission with the seller's agent, so they do have some incentive to get you into a home that fits what you want and need.

In the meantime, make sure you are a great candidate for getting approval. A good place to start here is annualcreditreport.com, the official government website to receive a free credit history from all three major bureaus. You'll want to check for public records, ie judgments, bankruptcies, and collections. If there are any, you'll want to get those resolved, or be sure you have the documents you need to show they are taken care of. Beyond that, if you have balances on your credit cards, keep working at whittling those away. Be aware of what "assets" you have, things like checking or savings accounts, 401K, IRA, anything you can use to show you have the money to move ahead with this pruchase. Having all this information easily available to you will make the process go much more smoothly.

What you might want to consider is using what is called a buyer’s agent. Basically, it puts a real estate agent in your corner too. They will end up splitting the commission with the seller’s agent, so they do have some incentive to get you into a home that fits what you want and need.

In the meantime, make sure you are a great candidate for getting approval. A good place to start here is annualcreditreport.com, the official government website to receive a free credit history from all three major bureaus. You’ll want to check for public records, ie judgments, bankruptcies, and collections. If there are any, you’ll want to get those resolved, or be sure you have the documents you need to show they are taken care of. Beyond that, if you have balances on your credit cards, keep working at whittling those away. Be aware of what “assets” you have, things like checking or savings accounts, 401K, IRA, anything you can use to show you have the money to move ahead with this pruchase. Having all this information easily available to you will make the process go much more smoothly.

You might want to use a lawyer. Depending on your state, that may actually be required if you don't pay cash, or it may save you money over using a standard title company. One thing is for certain, there's nobody else that is 100 percent on your side when buying a home.

The real estate agent works off of commission. The seller pays that, but that means that the more you pay, the more they get. I'm not saying they are all crooks, I'm saying that you need to consider that when weighing their advice. You want to talk to them a while before shopping houses, you're better off with one you feel comfortable driving around to strange places with, and who knows your tastes and budget and home needs.

The mortgage broker works for a lending company, and is selling a product. There are some really good people out there doing it, but there are some that think it's just easy money. You want to shop around for one you can trust, and I suggest talking to at least three. It'll take that much just to get used to the terminology. Don't waste more than ten minutes with one if they aren't asking you questions; there are more different programs than you can imagine, and to find out which one suits you, they need to be asking a lot of questions.

In case you don't get an attorney, here's two key points to make sure are in the offer you submit. 1) it has to be contingent on a home inspection. It's one thing if they won't FIX any problems, but there are some problems you don't want to buy, or at least not be surprised by after closing 2) contingent on you getting financing; deals fall through at the last minute because of financing, you want to be able to get your money back.

Here's one more thing to bear in mind that your realtor doesn't want you to know, so don't tell them you do know it:

If they accept your first offer, you offered too much.

I caution everyone to stay away from this company. I wish I had never heard of them. They bilked me out of $375 for a worthless appraisal. Their own paperwork says they have an interest in the appraiser they use. After they denied my "pre-approved" refinancing, I talked to a more reputable mortgage company rep. He said that, based on my credit score, they were never serious about refinancing my mortgage, and I should ask for my money back. Of course, they have refused.

I do not recommend this business at all. They took $375 from me for an appraisal when they never intended to refinance my house. I wondered why the salesperson kept trying to get me to say my house was worth more than I had told him the tax valuation was. Now I know that it was an excuse to turn me down once they got the results of the lowball appraisal they ordered. I do not recommend this business to anyone.

i don't recommend embrace either, they also took the $375 fee from me and 2 months later they could not close on my loan because the underwriters could not prove residency. This company is a joke, don't waste your time or money.

While H.R. 3221 was intended to "rescue" the housing industry, the elimination of the DPA program will have the exact opposite effect of its intended purpose. Not only did it eliminate DPA programs, it also instituted a downpayment requirement increase from 3 percent to 3.5 percent. This combination is a recipe for disaster and will further hurt the already crippled housing market.

I want to ask... I'm not sure if you know anything in regards to the specific DPA programs that were banned. It's my understanding that the DPA which were sanction are those initiated by the seller to motivate the buyer. Please correct me if I'm wrong.
